GPLHook reserves the right to update and amend these Terms of Service at any time without prior notice. Any new features or tools added to the existing program will also be subject to the Terms of Service. Continued use of the Program following any changes signifies your acceptance of the revised Terms.
Account Terms
- Age Requirement: You must be at least 18 years old to participate in this Program.
- Human-Only Accounts: Automated accounts, such as those created by “bots,” are strictly prohibited.
- Accurate Information: You must provide your legal full name, a valid email address, and any other information requested during the signup process.
- Single User Access: Each login is limited to use by one individual. Shared logins are not permitted.
- Account Security: You are responsible for safeguarding your account and password. GPLHook will not be liable for any loss or damage resulting from your failure to maintain security.
- Content Responsibility: You are solely responsible for any content or activity associated with your account.
- One Account Per Person or Entity: Each individual or legal entity is limited to a single account.
- Lawful Use: You must not use the Affiliate Program for any illegal activities or purposes. All usage must comply with applicable laws, including copyright laws.
- No Self-Promotion Earnings: The Affiliate Program cannot be used to generate commissions on your own GPLHook product purchases.
Affiliate Links and Graphics
- Unique Affiliate Code: Upon signup, you will receive a unique Affiliate Code. This code must be used in all promotional links, banners, or graphics.
- Guidelines and Modifications: GPLHook will provide guidelines and graphics for your use. While we reserve the right to update the design of these materials, we will notify you of any changes to their dimensions.
- Tracking Requirements: Proper utilization of special link formats (“Special Links”) is essential for accurate tracking and referral fee accrual. GPLHook will not be responsible for any missed commissions due to improper use of Special Links.
Customer Definition
Customers purchasing products through the Affiliate Program are considered GPLHook’s customers. As such:
- Policies and Pricing: All pricing, policies, and procedures for customer orders, service, and support will be determined solely by GPLHook.
- Price Changes: Prices and product availability are subject to change without notice. Affiliates are advised not to display specific pricing on their sites.
Your Responsibilities
As an affiliate, you are solely responsible for:
- Site Maintenance: The technical operation and maintenance of your site and related equipment.
- Legal Compliance: Ensuring your site complies with third-party agreements and legal standards, including those governing copyrights, privacy, and proprietary rights.
- Accurate Content: All materials displayed on your site, especially those related to GPLHook products, must be truthful and lawful.
- Privacy Disclosures: Your site must have a privacy policy that clearly discloses how you collect, use, and share visitor data, including cookie usage.
Compliance with Laws
Participation in the Affiliate Program requires adherence to all relevant laws, regulations, and policies. This includes but is not limited to anti-spam laws like the CAN-SPAM Act of 2003.
Term and Termination
- Agreement Term: This Agreement begins upon approval of your application and continues until terminated by either party.
- Termination Rights: Either party may terminate this Agreement at any time. Upon termination, you must immediately remove all GPLHook links, graphics, and related materials from your site.
- Program Termination: GPLHook reserves the right to discontinue the Affiliate Program at any time. Outstanding earnings above $20 will be paid upon termination.
Termination for Cause
GPLHook reserves the right to suspend or terminate your account at any time for reasons including:
- Fraudulent or illegal activity.
- Violation of these Terms.
- Aggressive or unethical sales practices.
Upon termination, all outstanding commissions earned under questionable circumstances will be forfeited.
Relationship of Parties
Affiliates and GPLHook are independent contractors. Nothing in this Agreement creates a partnership, agency, or employment relationship. Affiliates are not authorized to make statements or commitments on behalf of GPLHook.
Limitations of Liability
GPLHook is not liable for:
- Indirect or consequential damages, including lost profits or data.
- Errors or interruptions in the Program’s operation.
Disclaimers
GPLHook provides the Affiliate Program “as is” and makes no guarantees about its operation, including uptime or error-free performance.
Arbitration
Disputes arising from this Agreement will be resolved through confidential arbitration in accordance with the American Arbitration Association. Exceptions include claims involving intellectual property rights, which may be resolved in state or federal court.
Miscellaneous
- Governing Law: This Agreement is governed by the laws of the India
- Assignment: Affiliates may not transfer their rights or obligations under this Agreement without prior written consent.
- Entire Agreement: These Terms constitute the entire agreement between you and GPLHook, superseding any prior agreements.
